LDF torture victims demand M10 million

It doesn’t rain but pours for the Lesotho Defence Force (LDF).

Four more victims of torture are demanding M2.5 million each in compensation following their alleged brutal assault, unlawful arrest and inhumane treatment by soldiers last month.

The Attorney General, commander Lesotho Defence Force (LDF) and minister of defence and national security, are cited as respondents in the matter.

The applicants; Molemo Mosunyane, Kakaretso Tsapi, Retṧelisitsoe Moeti and Thabiso Mohlolo are demanding M2.5 million each (a total of M10 million).

Their lawyer, Advocate ‘Makopi Lesaane of NJ Chambers, in a letter claimed the damages arise from the torture, unlawful arrest and detention and inhumane treatment subjected to the clients.

The applicants allege that they were arrested by members of LDF on 13 August 2024 and ordered to produce firearms which they explained they knew nothing about.

They also claim that they were handcuffed while being belaboured severely with sticks on their chests, buttocks, thighs, stomach and legs.

They were thereafter taken to Ha Ratjomose Barracks whereat they were allegedly subjected to the same ordeal during the night until the following day, Friday 16 August 2024.

They also submit that they were detained from Tuesday to Friday afternoon when they were released and dropped at their respective homes by the soldiers.

“As a result of the torture meted out to our clients, they suffered shock, serious bodily harm and excruciating pain.

“This is a crime against humanity in terms of our Penal Code Act of 2010. Consequently, each client suffered damage in the amount of M2 500 000.  Clients contend that all material times the aforesaid members of LDF were acting in their official capacity. Consequently, the government of Lesotho is liable for their unlawful acts.

“This serves as the requisite statutory notice. We will file summons without further notice in the event our clients’ demand is not honoured within a period of 30 days of our letter. Your immediate cooperation will be highly appreciated,” the letter said.

Meanwhile, the demand comes only a month after Liteboho Mohloane of Lekhalong Ha Qamo, who was also allegedly tortured by the LDF, demanded M5 million in compensation.

However, Mahloane confirmed yesterday that the LDF has not honoured his demand nor responded to the letter. As a result, he will await guidance from his lawyer

In another development, Basotho National Party (BNP) leader Machesetsa Mofomobe has condemned recent incidents of brutality by members of the LDF, which have left some civilians dead and others injured.

Speaking at a press conference in Maseru Tuesday, Mofomobe lamented that the acts of brutality are happening under prime minister Samuel Matekane’s watch and he is blasé about them.

“We are committed to ensuring victims receive justice, especially since in most cases they are usually falsely implicated.

“It is against the law for members of the LDF to engage in search and arrest operations without partnering with the police. That contravenes Section 71 of the Police Act, which clearly delineates the respective roles of the police and the military.

“The prime minister would be better advised to rein in the soldiers, lest his administration is tainted by army excesses. Ironically, the same soldiers might turn on him one day,” Mofomobe cautioned.
